Bill making insult to ‘Vande Mataram’ a criminal offence passed in Rajya Sabha

New Delhi: The Rajya Sabha on Wednesday passed the Prevention of Insults to National Honour (Amendment) Bill, 2026, extending statutory protection to ‘Vande Mataram’ and making its deliberate insult a punishable offence under law.

The amendment seeks to place ‘Vande Mataram’ on par with the national anthem ‘Jana Gana Mana’ under the Prevention of Insults to National Honour Act, providing legal protection against intentional acts of disrespect.

Under the amended legislation, deliberate insult to the National Flag, the Constitution, the National Anthem and ‘Vande Mataram’ will constitute a criminal offence. Those found guilty may face imprisonment for up to three years, a fine, or both.

The Bill was passed amid protests by Opposition members, who demanded a statement from Union Home Minister Amit Shah on the alleged NEET question paper leak and police action against protesters. Despite the disruptions, Deputy Chairman Harivansh continued the proceedings and allowed the House to take up the legislation.

Replying to the debate, Minister of State for Home Nityanand Rai said ‘Vande Mataram’ had served as a powerful rallying cry during India’s freedom struggle and that respecting national symbols was the duty of every citizen. He said the amendment would further strengthen the protection accorded to symbols of national pride.

The Bill, introduced in the Rajya Sabha on July 24, comes as the country marks the 150th anniversary of the composition of ‘Vande Mataram’. It will become law after being passed by Parliament and receiving the President’s assent.
